1. General Provisions
These Terms of Use ("Terms") govern your access to and use of the website located at energyupgradecanada.com (the "Site"), operated by EnergyUpgrade Canada ("we", "us" or "our"), an independent advertorial publisher based in the Kitchener-Waterloo region of Ontario, Canada. By accessing, browsing or otherwise using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree with any part of these Terms, please discontinue use of the Site.
2. Definitions
- "Site" means energyupgradecanada.com and all of its pages and content.
- "Publisher" means EnergyUpgrade Canada, the operator of the Site.
- "User", "you" means any person who accesses or uses the Site.
- "Content" means all text, comparisons, tables, estimates, images, graphics, logos and other materials published on the Site.
- "Installers" means the third-party certified solar installation companies to whom quote requests may be referred.
3. Nature of the Site and Advertorial Disclosure
The Site is promotional material. All Content is advertorial in nature and is intended to provide general, plain-language information to help Canadian homeowners evaluate whether rooftop solar makes financial sense in 2026. The Publisher may receive referral compensation from featured companies when you request a quote or otherwise engage with an Installer. This relationship is disclosed prominently on the Site and does not influence the inclusion of critical assessments, pros and cons, or risk factors in our editorial comparisons.
The Site provides information and a quote-matching facility only. We are not a solar installer, electrician, financial advisor or insurer, and nothing on the Site constitutes professional, financial, engineering or legal advice. All figures, prices, payback periods and savings estimates are illustrative, are sourced from public utility rate databases and industry reports, and are not guarantees. Results are not typical and vary by household, province, roof orientation and electricity provider.
4. Scope of Services
Through the Site you can read balanced buyer's-guide comparisons, review provincial cost and payback information, and submit a form to request no-obligation quotes from certified local Installers. When you submit a quote request, the details you provide are forwarded to one or more Installers, who may contact you directly. The Site does not process payments, host customer accounts, or carry out installations. Any contract for goods or services arising from a quote is solely between you and the relevant Installer, and we are not a party to that contract.
5. User Obligations
By using the Site, you agree that you will:
- Provide accurate, current and complete information when submitting any form;
- Use the Site only for lawful purposes and in compliance with applicable Canadian and provincial laws;
- Not use the Site to transmit spam, malware, or any harmful or unlawful content;
- Not attempt to gain unauthorised access to the Site, its servers or related systems, and not scrape, harvest or copy Content using automated means without our written permission;
- Be at least 18 years of age, or have the consent of a parent or legal guardian, and be a homeowner or authorised decision-maker for the property in question.
6. Intellectual Property
All Content on the Site, including text, comparison tables, graphics, layout, the EnergyUpgrade Canada name and logo, is owned by or licensed to the Publisher and is protected by applicable Canadian and international copyright and trademark laws, including the Copyright Act (Canada). You may view and print Content for your own personal, non-commercial reference. You may not reproduce, distribute, modify, republish or create derivative works from the Content without our prior written consent.
7. Privacy and Personal Information
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use and disclose personal information in accordance with PIPEDA and CASL. By submitting information through the Site, you consent to the practices described in that policy.
8. Disclaimers and Limitation of Liability
The Site and its Content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose or accuracy. We do not warrant that the Site will be uninterrupted, error-free or secure, or that the information presented is complete, current or applicable to your specific circumstances.
To the fullest extent permitted by law, the Publisher and its operators shall not be liable for any direct, indirect, incidental, consequential or special damages arising out of or in connection with your use of the Site, your reliance on any Content, or any dealings between you and an Installer, including any installation, workmanship, pricing or warranty matters, which are the sole responsibility of the Installer. Nothing in these Terms limits liability that cannot be excluded under applicable consumer protection law, including the Consumer Protection Act, 2002 (Ontario).
9. Third-Party Links and Services
The Site may contain links to third-party websites and services, including Installers and resources such as Google Fonts. These links are provided for convenience only. We do not control and are not responsible for the content, privacy practices or availability of third-party sites or services, and the inclusion of any link does not imply our endorsement.
10. Force Majeure
We are not liable for any failure or delay in the operation of the Site caused by events beyond our reasonable control, including natural disasters, severe weather, power or internet outages, technical failures, labour disputes, epidemics, governmental actions or other force majeure events.
11. Changes to These Terms
We may revise these Terms at any time by posting an updated version on the Site with a new "Last updated" date. Material changes will be made reasonably apparent. Your continued use of the Site after any change constitutes your acceptance of the revised Terms.
12. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. You agree that the courts located in Ontario shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Site, subject to any non-waivable rights you may have to bring proceedings in your province of residence under applicable consumer protection law.
